GIFT CARD TERMS AND CONDITIONS

The following terms and conditions (“Terms”) apply to the use of THYSKIN Gift Cards and eGift Cards (collectively, "Gift Cards"). Your purchase and use of the Gift Cards constitutes your agreement to follow and be bound by these Terms.

REDEMPTION AND USE

Gift Cards may only be redeemed toward the purchase of eligible goods and services provided by functionofbeauty.com and may not be used towards the purchase of another Gift Card. Promotional Credit may not be used towards the purchase of a Gift Card. Gift cards may not be reloaded, resold, or used for payment outside of the thy-skin.com website; used for unauthorized advertising, marketing, sweepstakes or other promotional purposes; redeemed for more than face value; transferred for value; redeemed for cash; or returned for a cash refund (except to the extent required by law).  Once redeemed through the THY SKIN website, Gift Card balances must be applied to purchases prior to any promotional balance available.

Your Privacy

We use personal information in order to promote and provide our products and services, to ensure the security of our websites, and to run our business. We have set out below more information on the categories of personal information that we collect, the specific ways in which that personal information is processed by us, the legal bases which permit us to do this, and the types of partners with whom we share your personal information.

In some cases where we ask for your personal information, we do so in order for us to fulfil your request (e.g. needing your email address to send you a newsletter to which you have signed up). If you do not provide that personal information, we will not be able to process your request or order.

Prices

All prices we state include all applicable taxes, where appropriate. We take all reasonable care to ensure that the prices advertised are correct.

If, by mistake, we have mis-priced an item, we will not be liable to supply that item to you at the stated price. In the event of an error with any order, we will contact you as soon as possible and allow you to cancel your order. If you cancel the order, we will refund you any amounts already paid.

You may be required to pay a delivery charge as stated on our website.

We reserve the right to increase the price of our products and services. If we increase the price of our service, we may choose not to increase the price you pay. If your payment is lower than the advertised price on our website, we may refer to the price you pay as a ‘loyalty price’ or equivalent.

You confirm that the payment method being used belongs to you or is being used with appropriate authorisation from the owner.

All payments are subject to the approval of the issuer, and we will not be responsible if the payment fails verification or if the issuer refuses to accept or honour the payment for any reason. We may also report any suspicious transactions to the relevant authorities. We may decline to accept or take any payment without giving any reason. Please note that it can take 2 to 3 days (excluding weekends and bank holidays) to process your payment. Issues with your chosen payment method may result in delays to delivery of THY SKIN products.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Product Delivery

All Cosmetic Products are supplied by THY SKIN FZE.

You must review any guidance and instructions that accompany any Products before using them, including the Product Certificates if applicable. You are responsible for use of the Products in accordance with instructions.

If you become pregnant during your receipt of the THY SKIN Services, you must notify us to confirm that your product is pregnancy safe and stop using any Products immediately and contact us at natural.thyskin@gmail.com

If (1) you experience any side effects from your use of any Products, (2) you start a new medication, or (3) your medical circumstances change at all in any way, you must contact us at natural.thyskin@gmail.com

Cancellation Rights

If you are a consumer, you have the right to cancel an order at any time before delivery of the product.

To exercise your right of cancellation, you must give notice to us via email to natural.thyskin@gmail.com with "Subject: Cancellation [order number]".

If you exercise your right of cancellation after the THY SKIN Products have been delivered to you, you will be responsible for returning them to us promptly and in any event within 7 days after the day in which you let us know that you wish to cancel the order. We will supply the return address upon request of your cancellation.

You must take reasonable care to ensure that the THY SKIN Products are not damaged in the meantime or in transit. You are not able to cancel where goods have been used due to health protection or hygiene reasons.

We will refund the price you paid for the THY SKIN Products,  delivery costs are non refundable. Refunds will be processed via the same method used by you to purchase the THY SKIN.

If you return a product because it is defective or we have delivered it to you in error we will refund the price in full, together with any applicable delivery charges. You will otherwise be responsible for the costs of returning the products to us.

Customized Skincare Refund Policy

For our customized line, your satisfaction drives our mission. If THY SKIN custom skincare falls short of your expectations, we want to hear about it. Reach out to us at natural.thyskin@gmail.com within 7 days of receiving your order. We'll gladly offer a free one-time reformulation, if you still think it's not what you need, we will refund your product in full.

Our Liability

Nothing in these Terms shall operate to exclude or limit our liability (if any) for:

• death or personal injury caused by our negligence;
• fraud;
• fraudulent misrepresentation; or
• any matter which it would be illegal for us to exclude or attempt to exclude our liability.

The THY SKIN products are provided on an “as is” and “as available” basis, and are only suitable for use as non-medical cosmetic products. We make no representation or warranty, express or implied, regarding the THY SKIN Products, or any information or advice given to you. To the maximum extent permitted by law, we disclaim all such representations or warranties.

We are only liable to you for losses which you suffer as a direct result of our breach of these Terms and which are reasonably foreseeable. Unless otherwise required by applicable law, our liability to you for any claim arising from the subject matter of these Terms and the use of any THY SKIN  shall be limited to the amounts paid to us by you in relation to the THY SKIN Products in question.

Our Responsibility

We will provide you with THY SKIN Services to the best of our ability and in accordance with all applicable laws and regulations.

You confirm that all information you provide to us is accurate, up-to-date, and complete to the best of your knowledge. This includes your medical history and any answers to questions we may ask you before and during any consultation. If you do not understand any question we ask you, please check with us to avoid providing an incorrect answer. You acknowledge that providing us with any incorrect information may negatively impact your health.

You consent for the purposes of applicable data protection legislation to us storing and using your medical information in accordance with our Privacy Policy. You must notify us immediately if any information you have provided to us changes. We do not assume any liability for issues arising as a result of incorrect, out-of-date, or incomplete information provided by you.

You confirm that you are at least 18 years old, and are not aware of any reason why we cannot provide the THY SKIN Services to you.

You acknowledge that a consultation may not necessarily result in a recommendation for any particular Product, or any Product at all. We reserve the right to change your skin goals during or following a consultation if we deem it necessary in order to safely recommend and prescribe a given Product.

 Once you purchase a customized THY SKIN product, we will ask you to answer a series of questions about your medical history and skin goals. We may ask you to provide photographs and/or attend an online consultation with one of our team.

We may supply cosmetic products for you to use and you acknowledge that the customized cosmetic products are intended for you according to instructions provided within the time period recommended and only by you. We create safe skincare products to our best ability with high standard GMP practices, following strict EU formulation guidelines and only approved skin safe cosmetic ingredients are used and you acknowledge that the cosmetic products provided to you are unlicensed. 

You must only use the THY SKIN and any Products for your own personal use, and not on behalf of anybody else, including friends, partners, or family members. You acknowledge that the recommendations we provide may be tailored to your specific circumstances and may negatively impact the health of anyone else.

You must not use the THY SKIN Services for any unlawful purpose. We will not be liable for any costs, damages or losses arising from any use by you of the THY SKIN Services or any Products in breach of applicable laws and these Terms.

Your Responsibility

You also absolve professionals engaged by Us, who offer Services through the Website from any responsibility or liability whatsoever, for any medical, legal or financial events or outcomes related to services attained by us through the use of the services. 

You understand that for all consultations, before acting on any of the advice offered in/through the site, you should confirm that such action is applicable and suitable to you, by referring to your own medical practitioner or by obtaining a second and third opinion of other medical practitioners.

Our consultations are not aiming to diagnose you! We suggests cosmetic ingredients that are helpful for the problems declare to us. Such diagnosis should be done by your medical practitioner. It's your responsibility to state your cosmetic problem to us accurately.

Moreover, you understand that our products are freshly made it's your responsibility to use our products as per the instructed guidelines. Any deviation from those, THY SKIN is not liable.

When you order a customized product you understand that it's formulated for you and only and shall not be shared with anyone. Industry approve GMP practices are in place ensure you are getting a safe cosmetic product and you understand that the cosmetic products provided to you are unlicensed. 

You further absolve from all liability, Us and Our owners, managers, directors, employees, agents, partners, advertisers and/ or affiliates from any legal responsibility for any incorrect or misleading information provided by any professional or contained within the website.
